1. Definitions
- "ThreatX" (also referred to as "we," "our," or "us") is the entity providing the cybersecurity platform, subject to the Companies Act, 2013 in India.
- "Platform" means the ThreatX websites, applications, or any online portals offering cybersecurity or related services.
- "User" (also referred to as "you") includes anyone who accesses, uses, or registers on the ThreatX Platform, including experts and clients.
- "Services" refers to all offerings and functionalities provided via the Platform, including but not limited to cybersecurity consulting, AI threat intelligence, incident response, and marketplace facilitation.
- "Content" includes all text, data, software, images, or other materials accessible through the Platform.
2. Acceptance of Terms
By accessing or using the ThreatX Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws, including the Information Technology Act, 2000 and the relevant Indian cybersecurity, data protection, and e-commerce regulations.
Important Notice
If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately. Continued use of the Platform constitutes acceptance of any updates or amendments we may make.
3. Description of Services
ThreatX provides a range of cybersecurity-related services, including but not limited to:
- AI-powered threat intelligence
- Expert consultation and marketplace
- Security assessments and incident response
- Community discussions and user-driven content
All Services are provided on an "as is" basis and may be modified, suspended, or discontinued at any time. While we strive to provide accurate and timely information, no warranty is given that the Services will meet your specific requirements or expectations.
4. User Accounts
You may be required to create an account to access certain Services. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the confidentiality of your credentials
- Notify ThreatX of any unauthorized use of your account
ThreatX reserves the right to suspend or terminate any account for non-compliance with these Terms, suspected fraudulent activity, or as required by Indian law enforcement agencies.
5. User Obligations
You agree to:
- Use the Platform in compliance with Indian laws and regulations
- Respect intellectual property and confidentiality rights of ThreatX and other users
- Avoid posting content that is offensive, illegal, or harmful
- Refrain from accessing or tampering with non-public areas of the Platform
- Not engage in fraudulent, deceptive, or malicious cyber activities
Any violation of these obligations may result in suspension or termination of your account, and you may be subject to legal consequences under Indian law.
6. Payments & Refunds
6.1 Payment Processing
- All payments are processed in Indian Rupees (INR) unless specified otherwise.
- ThreatX may use third-party payment gateways compliant with RBI regulations.
- Users must ensure their payment details are accurate and up-to-date.
6.2 Refund Policies
- Refunds are governed by the specific service or subscription purchased.
- All requests for refunds must be made in writing via email to ThreatX support.
- Approved refunds are processed within the timelines permitted under Indian financial regulations.
In certain cases (e.g., suspected fraud, violation of these Terms), ThreatX reserves the right to withhold or cancel payments as necessary to protect users and comply with Indian regulatory requirements.
7. Intellectual Property
All content, trademarks, and other intellectual property on the Platform are owned or licensed by ThreatX. You may not use, reproduce, distribute, or create derivative works without explicit permission.
By submitting any content to the Platform (e.g., forum posts, comments), you grant ThreatX a non-exclusive, royalty-free license to use, adapt, and display such content, consistent with our Privacy Policy.
Any misuse of ThreatX’s intellectual property may result in legal action under the Indian Copyright Act or other relevant statutes.
8. Liability
8.1 Limitation of Liability
To the fullest extent permitted by Indian law, ThreatX shall not be liable for direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the Platform or the inability to use the Services. In no event shall ThreatX total liability exceed the amounts paid by you to ThreatX in the preceding six (6) months.
8.2 Indemnification
You agree to indemnify and hold ThreatX, its affiliates, and employees harmless from any claims, losses, liabilities, or expenses (including legal fees) arising out of your breach of these Terms, misuse of the Services, or infringement of any third-party rights.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, or other liabilities that cannot be excluded under Indian law.
9. Termination
ThreatX reserves the right to suspend or terminate your access to the Platform for any violation of these Terms or if required by Indian regulatory authorities. You may also request account deletion at any time.
Upon termination, all licenses granted under these Terms immediately cease. ThreatX is not liable for any loss of data or other damages resulting from termination.
10. Dispute Resolution
These Terms shall be governed and construed in accordance with Indian laws, particularly the Information Technology Act, 2000 and the Digital Personal Data Protection Act, where applicable.
In the event of any dispute, you agree to first attempt an amicable resolution by contacting ThreatX support in writing. If unresolved, any legal proceedings must be brought in the courts of [City], India, which shall have exclusive jurisdiction.
